The First Rock-Paper-Scissors Mega Battle (“Event”) Terms and Conditions

1. To participate in the Event, please purchase e-tickets for the Event in advance via the NF Touch app. Only NF Touch members (“Members”) are entitled to purchase Event e-tickets.
2. Participants of the Event (“Participants”) will be divided into groups and shall compete during the time slot indicated on their e-tickets. Each participant can only compete once in any single round.
3. The date, time, venue, number of attendees and structure of the Event may be changed or the Event may be cancelled for any reason and at any time without prior notice or compensation. Please pay attention to any notices on NF Touch and/or the relevant shopping mall’s official mobile app, website and/or social media channels and/or at the relevant venue.
4. The Event is subject to these terms and conditions, the NF Touch Membership Programme Terms and Conditions (see https://www.nftouch.com.hk/en/terms-conditions) and other applicable terms and conditions.
5. Each e-ticket for the Event is only valid during the designated time period specified on the e-ticket. The said time period cannot be changed. Please arrive at the venue 20 minutes before the commencement of the designated time period to participate in the Event and collect the official participant T-Shirt. The e-tickets are subject to the “The First Rock-Paper-Scissors Mega Battle” E-Ticket Terms and Conditions (see https://bit.ly/4a5z7Vw) and other applicable terms and conditions.
6. The relevant The Mills e-Coupon(s) will be added to the Member’s wallet in the NF Touch mobile app automatically upon successful purchase of the Event e-ticket. The e-Coupon is subject to further terms and conditions set out on the e-Coupon and the terms and conditions of the merchant.
7. All e-tickets will be sold on a first-come-first-served basis while stocks last.
8. Participants must be aged 3 or above. Participants aged 3 to 12 must be accompanied by at least one (1) parent or legal guardian at all times.
9. Each Participant hereby confirms that he/she has read, understood and agreed to the “Participants’ Liability Waiver and Release”
10. All procedures must be completed in accordance with the instructions of the staff of The Mills Operation Limited (“Nan Fung”). Each Participant is required to present a valid Event e-ticket and complete a registration form in order to participate in the Event. The staff of Nan Fung may also require Participants to provide identification document(s) and/or other personal data (which may include but are not limited to their name, age, phone number, membership information and/or payment/credit card information) for verification, payment,  internal administrative and/or auditing purposes (as the case may require). Certain documents and information provided may be scanned or photocopied for internal record. A Participant may refuse to provide the requisite information, but Nan Fung may not be able to carry out the relevant procedure for the Participant or may even have to disqualify the Participant from the Event or any part thereof in that case.
11. Upon collection of the official participant T-Shirt, the Participant is deemed to have accepted in all respects the existing condition of the T-Shirt, Nan Fung and its affiliates shall have no liability and shall not be held responsible or liable in the event of any loss or damage related to any aspects of the T-Shirt, and no replacement will be made after collection.
12. Participants must ensure that all information they submit is true and correct.
13. Before providing any personal data, the Participant shall thoroughly read and accept the Privacy Policy ([website]) and Personal Information Collection Statement ([website]) of Nan Fung. A person below the age of 18 must consult his/her parent/legal guardian regarding the relevant Privacy Policy, Personal Information Collection Statement and terms and conditions, and duly obtain the consent of his/her parent/legal guardian to his/her provision of personal information.
14. Participation in the Event must be carried out in accordance with the Game Rules & Terms (see [website]) and the instructions of the staff of Nan Fung and the organizer.
15. The Event format, including bracket type (e.g., single-elimination, double-elimination), number of rounds, and progression criteria, will be determined and announced by Nan Fung in its sole and absolute discretion.
16. Participants must compete honestly and in good faith. Cheating, collusion, bribery, intimidation, harassment, abusive language, threatening behavior, discrimination, or unsportsmanlike conduct are strictly prohibited and may result in immediate disqualification and removal from the venue without refund.
17. The Event (including all materials, tools and prizes (if any)) is organized/provided by third-party organizer(s).  Nan Fung and/or its affiliates give no guarantee or warranty in relation to the Event (including but not limited to the content, facilities, relevant materials, finished products and services).  Nan Fung and/or its affiliates shall have no liability and shall not be held responsible or liable for any complaints, claims, losses or damages related to the Event whatsoever, including but not limited to any direct or indirect loss or damage related to the accuracy, quality, usage and/or any other aspects of the Event.
18. In no event shall Nan Fung and/or its affiliates be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond their reasonable control including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, shortages of labour or materials, fires, floods, storms, inclement weather, explosions, acts of God or delays or non-performance by third parties.
19. The Event may be subject to delays, errors or omissions resulting from technical issues such as problems with machines, servers or networks, etc., Nan Fung and/or its affiliates shall have no liability and shall not be held liable for any delays, errors, omissions and/or any loss and/or damage in connection therewith.
20. All e-tickets, e-coupons and T-shirts cannot be exchanged, refunded, transferred or traded for cash, other products, gifts or services. All souvenirs or any other complimentary items (if any) provided by the organiser to participants are non-transferable, non-exchangeable, and must not be sold, resold, traded, or offered for sale in any manner.
21. Participants acknowledge and accept all risks associated with the participation in the Event and confirm that their physical condition is suitable for participating in the Event. Participants must sign a liability waiver and acknowledgement form before taking part in any game matches. No participant will be allowed to compete without completing and signing the required form.
22. Participants and their parents/legal guardians (if applicable) agree that their participation in the Event is at their own risk, and they shall be responsible for their own safety, the safety of the person(s) they are accompanying (including any children) and their respective personal belongings, and shall not cause any danger, injuries or nuisance, etc. to others or the property of others.
23. Nan Fung and/or its affiliates shall not be responsible or liable for any illness, injury or damage/loss of property (including but not limited to liabilities, claims, demands or damages actual or consequential, disclosed or undisclosed, known or unknown, suspected or unsuspected) caused by or in connection with the Event (including any materials, facilities and the finished products), and Participants shall be solely responsible for all such risks, liabilities, claims, demands and/or damages. Participants hereby waive any related claim or cause of action against Nan Fung and/or its affiliates, and release them from such liabilities. If a Member designates another person to participate in the Event (subject to the approval of Nan Fung and the organizer) (“Designated Person”), the Member and the Designated Person shall be jointly and severally responsible for all such liabilities, claims, demands and/or damages arising out of or in connection with any act, default, neglect or omission of the Designated Person (including but not limited to liabilities, claims, demands or damages actual or consequential, disclosed or undisclosed, known or unknown, suspected or unsuspected),  and shall indemnify and hold harmless Nan Fung and its affiliates in respect of the same.
24. The Event may be photographed and/or video-recorded by Nan Fung and/or its affiliates. Participants agree to be photographed and/or video-recorded during the process and hereby agree to Nan Fung’s and/or its affiliates’ use (including dissemination or publication) of such photographs and/or videos for commercial or promotion purposes.
25. All images, descriptions (including the product value (if any)) and marketing materials are for reference only.
26. The Event may be cancelled, altered or delayed due to inclement weather conditions or other factors. Nan Fung reserves the right to make rearrangements depending on the actual situation and reserves the right of final decision.
27. Nan Fung reserves the right to modify the structure and content of the Event at any time without prior notice, including but not limited to: any content of the mobile app or website; the redemption/purchase method; these terms and conditions; the game rules; other items; and/or termination of the Event. Participants should read the latest information about the Event, including the latest version of these terms and conditions and the game rules, before participating in the Event. Whenever a Participant participates in the Event, he/she confirms that he/she has accepted all relevant changes to the structure, the game rules and content of the Event. Nan Fung and/or its affiliates will not be responsible/liable for any loss and/or damage resulting from changes to the structure and/or content, including any alteration and/or update of the terms and conditions.
28. By participating in the Event, the Member and the Participant hereby confirm their acceptance of all terms and conditions of the Event and the Privacy Policy and Personal Information Collection Statement of Nan Fung. If a Member/Participant is below the age of 18, he/she confirms that he/she has consulted his/her parent/legal guardian regarding the relevant Privacy Policy, Personal Information Collection Statement and terms and conditions, and has duly obtained the consent of the parent/legal guardian to his/her provision of personal information and (if applicable) his/her participation in the Event.
29. In case of any disputes, Nan Fung reserves the right of final decision.
30. No person other than the relevant Member, Participant, Nan Fung and its affiliates will have any rights under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefits of any of the provisions of these terms and conditions.
31. The English version of these terms and conditions shall prevail wherever there is any discrepancy between the Chinese and English versions.
32. These terms and conditions shall be construed and governed by the laws of the Hong Kong Special Administrative Region (“Hong Kong”) and all parties shall submit to the exclusive jurisdiction of the courts of Hong Kong.
